Firm partners, Matthew J. Malinowski and Robert Johnston spoke at a CLE Live Webinar on Thursday, June 25, 2020. Among other things, they discussed emotional appeals (both rational and irrational) in complex commercial and personal injury trials, including methods for embracing emotion and countering it through simplified presentation to judges and juries of salient facts, science, and concrete evidence.
Mr. Malinowski focuses his practice on highly complex, "bet the company" trials and litigation. He has defended corporate clients in serial mass tort litigation and trials, including both state and federal multidistrict litigation. He specializes in the areas of medical device and pharmaceutical products liability defense, multiple plaintiff serial trials and related litigation, high-stakes financial and commercial contract disputes, high-dollar lost business value and business interruption claims, putative class action, and mass groundwater and soil contamination cases.
Mr. Johnston's practice focuses on trials and appeals of complex litigation matters, with an emphasis on defending pharmaceutical products liability litigation and on prosecuting insurance coverage disputes for corporate clients. He manages the defense of class action, consolidated, and serial litigations as well as significant individual matters. Robert has developed key liability defenses to sweeping allegations of corporate misconduct, and has worked with experts and senior company employees to advance those defenses in depositions and at trial.
