Kathleen O. Gallagher practices in the Firm’s Complex Litigation, Government Contracts, and Toxic Torts & Products Liability groups.  Her practice involves commercial litigation claims and disputes focusing on the areas of complex construction and engineering litigation and arbitration in federal and state courts, and government contract disputes and claims before the Armed Services Board of Contract Appeals and the U.S. Court of Federal Claims.  She represents clients in complex contract disputes involving government contractors and commercial contractors, subcontractors, suppliers, and architect-engineers in breach of contract and design claims, and defective workmanship actions.  Ms. Gallagher has drafted pleadings, dispositive motions, written discovery, taken and defended depositions, and appeared for and argued in motions hearings and court conferences.  She has also served as a trial team member in court for a multi-party complex engineering and construction trial lasting several weeks, and participated in all aspects of trial preparation, including pre-trial motions, legal research, and witness preparation.

Ms. Gallagher has defended mass tort and related litigation brought against various corporate defendants in state and federal courts across the country.  She has authored a wide variety of motions and briefs, including summary judgment, motions to dismiss, and motions in limine on substantive, procedural, and evidentiary issues such as statutes of limitations, products liability claims, breach of warranties, fraud and misrepresentation claims, punitive damages, and exclusion of expert testimony.  Due to the highly technical nature of her caseload, she routinely works with expert witnesses to develop case-specific opinions and prepares expert witnesses to provide testimony at deposition and trial.

Ms. Gallagher also has experience in the areas of personal injury and wrongful death claims, and insurance defense and coverage, as well as with criminal cases.  She has experience in both bench and jury trials, as first and second chair, as well as mediation and settlement negotiations at the state and federal levels.  Prior to joining the Firm, Ms. Gallagher clerked for the Honorable John W. Debelius III, Chief Judge of Sixth Judicial Circuit, and Chief Administrative Judge of the Circuit Court for Montgomery County, Maryland.

Ms. Gallagher graduated from the University of Baltimore School of Law in 2014, where she was the Articles Editor of the University of Baltimore Law Forum, competed on the J. Braxton Craven Memorial Moot Court Competition team, and was a member of the Moot Court Board.  She also served as a teaching assistant in constitutional law and a research assistant on cyberbullying and anti-harassment laws.
